Privacy Policy
Woodall Rodgers Park Foundation, a non-profit company registered in Texas (“The Park”), has created this Privacy Policy (“Policy”) in order to demonstrate our firm commitment to the privacy of your personal information. The following discloses our general policies relating to information gathering and dissemination practices for this Web site (the “Site”).
This Policy tells you, among other things, what information we gather from you through our Site, how we may use or disclose that information, and our efforts to protect it.

Subscribe to a newsletter or ask to be added to our mailing lists.
Register or sign-up to subscribe to a service.
Make a donation in support of The Park.
In connection with your use of our Site, we may collect the following information:
The domain and/or IP address, but not the e-mail address of visitors to our Site. The e-mail addresses of users who communicate with us via the Site or via e-mail. Aggregate information on what pages on our Site users access or visit. Information volunteered by the user, such as information provided if they become supporters of The Park, which may include name, address, e-mail, phone number, fax number, username, password, e-mail address, company name, information posted if you participate in any of our discussion boards, and general requests for information and other personal information. Information you might post to user or discussion community aspects which may be included in the Site.Providing the voluntary data described above is at your sole discretion. If you submit personally identifiable information to us through the Site, then we use your personal information to operate, maintain, and provide to you the features and functionality of the Site. We use both your personally identifiable information and certain non-personally-identifiable information (such as anonymous usage data, cookies, IP addresses, browser type, clickstream data, etc.) to improve the quality and design of the Site and to create new features, functionality, and services by storing, tracking, and analyzing user preferences and trends.
The Park is the owner of the information collected on this Site. The information is not collected for sale to third party marketers and we do not sell or distribute the information collected from the site for commercial marketing purposes. Except as provided in this Policy, we do not disclose any nonpublic personal information about you to anyone except as permitted by law, however, we may choose to disclose all of the information we collect, as described above, to companies that perform services on our behalf, such as payment processors, data processors, technical systems consultants and programmers and the advertising firms that we use to promote our Site. Additionally, this information may be shared with The Park partners. We may use the personal identifying information you provide to monitor usage and traffic-levels, analyze trends, administer the Site, track user movement, and gather broad demographic information for aggregate use. We may also use your information to contact you regarding improvements we can make to our Site and our services. The Park may also share aggregate information about our users with advertisers, sponsors and other third parties, though such summary information will not identify any specifics directly related to your identity. We may also provide analysis based on the information we collect, to our strategic alliance partners and other risk sharing partners.
We may use your e-mail address to assist you if you forget your log-in information and to send you information about The Park such as our Online Newsletter. We may also use your e-mail address to contact you directly regarding events, activities of The Park or information that we believe might interest you. Only The Park (or agents working on behalf of The Park or with the permission of The Park) will send you these direct mailings. If you do not want to receive such mailings, you can easily opt-out of receiving further marketing from The Park as provided in Choice/Opt Out below.
You authorize us to disclose any information about you to law enforcement or other government officials as we, in our sole discretion, believe necessary or appropriate, in connection with an investigation of fraud, intellectual property infringements, violation of obligations to us under our Terms of Service Agreement or any other agreement or policy, or other illegal activity.
We will not sell, share, or rent this information to others in ways different from what is disclosed in this statement.
Public Forums
This Site may utilize public forums, which may include blogs, forums, message boards and other interactive features. Please remember that any information that is disclosed in these areas is not protected as confidential and becomes public information. You are solely responsible and should exercise caution when deciding to disclose any personal information in these areas.
Abuse of Terms of Service Agreement
We have the right to share your name and contact information with our attorneys and law enforcement officials, if needed, in the event we believe you have breached our Terms of Service Agreement.
Collection and Use of IP Addresses
We may use IP addresses to analyze trends, administer the Site, track user’s movement, and gather broad demographic information for aggregate use. IP addresses are not linked to personally identifiable information. Please see Notice of Information Collected and Disclosed above for more information.
Cookies
We may use cookies (a small data file that certain Web sites write to your hard drive when you visit them), log files, clear gifs or web beacons (known as action tags or single pixel gifs) information to: (a) remember information so that you will not have to re-enter it during your visit or the next time you visit the Site; (b) provide custom, personalized content and information such as the services you subscribe to; and (c) to assess the popularity and effectiveness of the material posted on the Site. We may also use web beacons or similar technology in connection with e-mails sent to users, to let us know whether and when the e-mail was opened. Confidentiality of Transmissions
Please remember that transmissions on the Internet are not always confidential. You are transmitting this information at your own risk. Please see Security below for more information.
Password Protection
To protect your privacy and security, we take reasonable steps (such as requesting a unique password) to verify your identity before creating your user account. The user that created the account for a user is responsible for maintaining the secrecy of a users unique password and account information at all times.
Disclosure Choices
You may, of course, decline to submit personally identifiable information through the Site, in which case The Park may not be able to provide certain services to you.
Choice/Opt Out
If you prefer that we not disclose nonpublic personal information about you to nonaffiliated third parties, you may opt out of those disclosures; that is, you may direct us not to make those disclosures (other than disclosures permitted by law). If you receive communications from us that you do not want to receive, you can opt out from receiving these communications, by specifically telling us to stop sending them to you. We will generally be able to give effect to your withdrawal on 30 days’ notice. If you wish to opt out of disclosures to nonaffiliated third parties, you may e-mail your request to The Park at info@theparkdallas.org.
Onward Transfer (Transfers to Third Parties)
We will apply the Notice and Opt-out policies discussed above in the event we propose to disclose your information to a third party.
Security
We treat data as an asset that must be protected and use lots of tools (encryption, passwords, physical security, etc.) to protect your personal information against unauthorized access and disclosure.
All donations are processed utilizing PayPal which has its own privacy policies that relate to the data they process. Please click here to review their privacy policies.
Information you elect to post on the Site, e-mails and other information you send to us, except that which you send us on a secure page, is not encrypted and such transmissions cannot be considered a secure means of transmitting sensitive information. The Park will never ask you to submit your financial data, such as your credit card account numbers, via e-mail. IF YOU RECEIVE AN E-MAIL REQUESTING THAT YOU FORWARD INFORMATION OF THIS NATURE BY E-MAIL, PLEASE CONTACT US DIRECTLY AT info@theparkdallas.org. DO NOT REPLY DIRECTLY TO THE E-MAIL. You should be aware of the limitations of security, authentication, encryption, and privacy measures used in connection with the Internet and that any information you transmit through the Site may be damaged, corrupted, "sniffed" and/or accessed by another person without your permission.
Regardless of the precautions taken by you or by us, “perfect security” does not exist on the Internet. Third parties may unlawfully intercept or access transmissions or private communications, and other users may abuse or misuse your personal information that they collect from the site. Therefore, although we work very hard to protect your privacy, we do not promise, and you should not expect, that your personal information or private communications will always remain private. We cannot ensure or warrant the ultimate security of any information you transmit.
Linked Sites
The Site may contain links to other sites. Please be aware that The Park may not be responsible for content or the privacy practices of such other sites. We encourage our users to be aware when they leave our Site and recommend that they read the privacy statements of each and every Web site they visit. This Policy applies solely to information collected by this Site.
It should be noted that The Park utilizes third party vendors for commercial transactions. Specifically, The Park utilizes PayPal, which provides its own detailed Privacy Policy and User Agreement. Please review those policies carefully before you disclose any personal information.
Age Restrictions; Children’s Privacy
This Site is not directed at children under the age of 13 and does not knowingly collect personal information from children under the age of 13. If The Park obtains actual knowledge that it has obtained personal information about a child under the age of 13, that information is immediately and permanently deleted from our records.
Changes to Privacy Policy
We may occasionally change this Privacy Policy. If we do, we will post the changes on the Site. The changes will take effect as soon as posted.

Acceptance of Privacy Statement
Your use of our Site, including any dispute concerning privacy, is subject to this Policy and the Terms of Service Agreement. BY USING OUR SITE, YOU ARE ACCEPTING THE PRACTICES SET OUT IN THIS PRIVACY POLICY AND OUR TERMS OF SERVICE AGREEMENT. We reserve the right to modify this Policy at any time by posting the changes on this page. The Park will provide you notice of any updates, revisions, supplements, modifications or amendments to this Agreement by placing a “Notice of Modification” link on the Home Page for a 30-day period following the initial posting on the Site. TERMS OF USE AGREEMENT
This Terms of Use Agreement (“Agreement”) constitutes a valid, binding contract between you and Woodall Rodgers Park Foundation, a Texas nonprofit corporation (“The Park”), the owner and operator of www.theparkdallas.org, with respect to the use of this website (the “Site”). Your access to the Site is provided subject to compliance with the terms of this Agreement and Your use of this Site signifies and constitutes your acceptance of this Agreement, as it may be amended from time to time. Please read this Agreement carefully as it forms a binding contract between you and The Park. Please print a copy of this agreement for your records.
The Park takes the issue of privacy on the Internet very seriously. To view our privacy statement, click here. If you access certain services on our Site, such as portions of the Site which may require registration or log-in for access, then you may also be subject to other applicable rules and policies which are available on the log-in pages for the applicable interactive services.
License and Site Access
The Site is intended to provide information to supporters and other interested regarding The Park’s activities. The Park grants you a limited, revocable, non-transferable, and non-exclusive license to use the object code of the Site on a single computer and not to download (other than page caching) or modify it, or any portion of it. Neither the Site nor any portion of the Site may be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any purpose without express written consent of The Park. Except with express written consent of The Park, you shall not (and shall not allow any third party to) copy, modify, create a derivative work from, reverse engineer, reverse assemble or otherwise attempt to discover any source code, sell, assign, sublicense, grant a security interest in or otherwise transfer any right in the software for the Site. The license does not include resale of this Site or its contents, or collection and use of any content or any derivative use of this Site or its contents. You agree not to engage in any conduct that restricts or inhibits any other person from using or enjoying the Site, or which, in the judgment of The Park, exposes The Park or any of its affiliates to any liability or detriment of any type. You must be courteous to other users of the Site. Personal attacks are grounds for being banned. If you have a problem with something that another member has posted in the forums please contact us at info@theparkdallas.org. Do not post a personal attack or other response. Harassing members of the Site in any way will not be tolerated. If a member has advised you that they do not wish for you to contact them, it is your responsibility to respect this request. If you are found to be harassing any member of the Site, The Park reserves the right to ban you from the Site. If you are being harassed, please notify us immediately at info@theparkdallas.org. Violating this Agreement may lead to you being immediately and permanently banned, with notification of your Internet Service Provider if deemed required by us. The IP address of all posts are recorded to aid in enforcing this Agreement.
User Communications and Unsolicited Idea Submission
By voluntarily submitting electronic communications (including pictures and anecdotes) to or through the Site, you agree that such submissions are non-confidential for all purposes and agree to any information you provide being stored in a database. Please note, it is The Park’s policy not to review or consider ideas, suggestions, or proposals other than those we specifically request. The intent of this policy is to avoid the possibility of future misunderstandings if activities of The Park might be similar or even identical to your idea. You agree that if you send The Park a comment or feedback or an unsolicited suggestion, idea, or proposal (collectively, the “Submissions”), the Submission is non-confidential and non-proprietary. You further agree that such Submissions become the property of The Park and that all title and interest therein, including all rights of copyright, rests with The Park at the time they are submitted. The Park has no obligations concerning the Submissions, contractual or otherwise (including, but not limited to, an obligation to keep the Submissions confidential), and will not be liable for any use or disclosure of any Submission. Submissions are subject to being used, reproduced, modified, published, edited, translated, distributed, performed and displayed in any media or medium, or any form, format or forum now known or hereafter developed, for any purpose, in perpetuity without further notice and The Park is entitled to unrestricted use of Submissions for any purpose whatsoever, commercial or otherwise, without compensation to you.
All content on the Site, including user postings, is provided "AS IS," and you are solely responsible for your reliance on and use of such content. The Park is not responsible for the consequences of any communications made through the Site. You agree not to, without the express approval of The Park, distribute or otherwise publish any material containing any solicitation of funds, advertising or solicitation for goods or services.
Third Party Copyrights
The Park respects the intellectual property of authors and creators of written works and visual images and we ask our users to do the same. A copyright exists in nearly all text, images and artwork. Copyright vests in its owner the exclusive right to make copies, publicly distribute copies, publicly display the work, and prepare other works based on the original. Federal law provides both civil and criminal penalties for violation of a copyright. The Park and this Site’s users are each subject to the copyright laws. You represent and warrant that you possess all necessary rights to use the content that you submit to The Park and that use of such content does not violate the foregoing. You agree to defend, indemnify, and hold us harmless from and against any and all claims arising out of or relating to any content that you submit to us. Unauthorized Data Collection
Systematic retrieval of data from this Site to create or compile directly or indirectly, in whole or in part, a collection, compilation, database or directory without the express written permission of The Park is strictly prohibited. You agree that you will not use any robot, spider, other automatic device, or manual process to monitor or copy our web pages or the content contained herein. You may not engage in the practices of “screen scraping,” “database scraping,” or any other practice or activity the purpose of which is to obtain lists of users, portions of a database, or other lists or information from this Site, in any manner or in any quantities not authorized by The Park. Intellectual Property Rights
The Site is protected by copyright, trademark, trade dress and other intellectual property rights.
(a) The Park’s logos and other trademarks, service marks, labels, product names and service names, including without limitation the Name, “The Park”, the tagline “common ground. uncommon beauty.”, and the logo (collectively, the “Marks”) are owned or licensed by The Park. You may not use meta tags or any other “hidden text” utilizing The Park’s name or trademarks without the express written consent of The Park. You agree not to copy, display or otherwise use any of the Marks without the prior written permission of The Park. Notwithstanding the foregoing, the Marks may not be used in any manner likely to cause confusion, disparage or dilute these marks and/or in connection with any product or service that is not provided by The Park.
(b) The entire Site, and all object code and source code, text, graphics, multimedia content, including but not limited to images, illustrations, audio and video clips, html and other mark up languages, and all scripts within the site associated therewith, are copyright 2009 Woodall Rodgers Park Foundation. All rights reserved. The copyrighted and proprietary property of The Park may not be duplicated or used without The Park’s express prior written consent. YOU AGREE TO DEFEND, INDEMNIFY AND HOLD COMPLETELY HARMLESS THE PARK FROM AND AGAINST ANY AND ALL CLAIMS, DAMAGES, COSTS, AND EXPENSES, INCLUDING WITHOUT LIMITATION CLAIMS BASED UPON THE NEGLIGENCE OF The Park, ARISING FROM OR RELATED TO YOUR USE OF THE SITE, THE MATERIALS IT CONTAINS, AND ANY SITES LINKED TO THIS SITE OR YOUR USE OF THE INFORMATION CONTAINED ON THE SITE OR YOUR USE OF THE INFORMATION CONTAINED ON THIS SITE.
